New court ruling allows tribal online gambling in Florida
A recent ruling by the DC Circuit Court has reversed a previous decision that prohibited the Seminole tribe from offering online wagering in Florida.
Back in 2021, the Seminole tribe entered into an agreement with the government of Florida, which allowed the former to offer wagering services with its Hard Rock brand in the state. The tribe had both land-based and online offerings, the latter of which was operated out of its tribal lands, however, it was still available in all of Florida.
Two gambling operators, Bonita-Fort Myers and West Flager Associates, filed a lawsuit with a court in DC, challenging whether operating online gambling services out of tribal lands for the entirety of the state could be considered gambling on those lands. The two companies won the lawsuit, with the final verdict ruling that the agreement violated Florida’s constitution.
The lawsuit shut down the tribe’s online offerings only about a month after they went live, driving the Seminoles to appeal the decision. Recently, a higher DC court, the Circuit Court, ruled that the agreement was not unlawful, reinstating it in the state and allowing the tribe to continue offering online wagering services.
