DraftKings wins legal battle against former VP
In its legal battle with Mike Hermalyn, its former vice president of VIP, DraftKings came out victorious.
Hermalyn’s participation at his new company, Fanatics Betting and Gaming, is limited as a result of the temporary injunction that DraftKings requested and was granted by the Massachusetts Federal Court. Moreover, the court denied Hermalyn’s request to have the lawsuit dismissed.
DraftKings accused Hermalyn of stealing trade secrets and attempting to snatch DraftKings staff members for Fanatics, which led to this conflict. Hermalyn is still permitted to work at Fanatics in spite of this decision, although he cannot do any tasks related to DraftKings’ operations that he was involved in or about which he obtained confidential data six months before February 1, 2024.
On a number of grounds, the judge sided with DraftKings, concluding that non-compete and non-solicitation clauses were enforceable. The decision brought to light contradictions in Hermalyn’s testimony, implying that he had lied to both the court and his previous employer. For example, Hermalyn said he moved data over Slack, but the DraftKings IT team insisted that One Drive was the platform.
Supporters applauded the court’s ruling but criticized DraftKings for what they claimed to be a terrible workplace environment. However, DraftKings highlighted the court’s evaluation of Hermalyn’s behavior, characterizing his evidence as deceptive and evasive. They want to carry on with their legal lawsuit against him.
